Re:  Part VII application by Shaw Cablesystems Limited seeking an order granting access to highways and other public places in the County of Wheatland, Alberta

On 30 April 2008, the Commission received a letter from Wheatland County (the County) objecting to Commission staff's letter, dated 29 April 2008, that the Alberta One-Call comments dated 21 April 2008 was out of process and would not form part of the record of the above proceeding and arguing that the decision to accept and consider or reject the Alberta One-Call submission ought to be a decision of the Commission.

The Commission notes that the County submitted that Alberta One-Call's comments should be considered as it sought to clarify incorrect and inaccurate comments made by Shaw.

The Commission notes that the information, which Alberta One-Call sought to clarify in its 21 April 2008 comments, was submitted by Shaw in its 19 November 2007 application.   The Commission also notes that Alberta One-Call had the opportunity to file comments, in response to Shaw's application, and did so by filing comments on 18 December 2007.

Accordingly, Alberta One-Call's comments dated 21 April 2008 will not form part of the record of this proceeding and will therefore not be considered by the Commission in its deliberations.
