Re: Canadian ownership and control requirements under the Telecommunications Act
It is my understanding that your company was a successful bidder in the Government's auction for spectrum licences for advanced wireless services.
As you will know, under the Telecommunications Act a Canadian carrier must be Canadian owned and controlled in order to be able to be operate. The Canadian Radio-television and Telecommunications Commission is responsible for ensuring that this requirement of the Act is complied with by Canadian carriers. While I understand that your company is not yet utilizing the spectrum you bid on to operate as a Canadian carrier, once your company is operating it will need to be compliant with the Canadian ownership provisions of the Act. In order to assist your company the Commission is prepared to review your ownership prior to your commencement of operations in order to ensure that it meets the requirements of the Act.
