Re: Part VII Application to Review and Vary Telecom Order CRTC 2008-305

 

Dear Mr. Bibic:

 

On 1 December 2008, and pursuant to section 62 of the Telecommunications Act (the Act) and Part VII of the CRTC Telecommunications Rules of Procedure, Bell Canada and Bell Aliant Regional Communications, Limited Partnership (Bell Canada et al.) requested that the Commission review and vary Telecom Order CRTC 2008-305, Bell Aliant Regional Communications , Limited Partnership and Bell Canada - Elimination of the recurring balance in Bell Canada's deferral account , dated 30 October 2008 (Order 2008-305).

 

In its application, Bell Canada et al. oppose the Commission's directive in Order 2008-305 that rate reductions be made to residential optional local services as a result of the clearing of the recurring balance in Bell Canada 's deferral account.   Bell Canada et al. have requested that the Commission stay Order 2008-305, pending the determination of this application.

 

Section 50 of the Act allows the Commission to extend the period for doing anything required to be done under any of its decisions.   That provision reads:

 

The Commission may extend the period, whether fixed by regulation or otherwise, for doing anything required to be done in proceedings before it or under any of its decisions.

 

The Commission considers it appropriate in the circumstances to extend the period by which Bell Canada et al. are to implement the various directions set out in Order 2008-305 to a date, or dates, as appropriate, to be determined by the Commission as part of its disposition of Bell Canada et al.'s 1 December 2008 application to review and vary Order 2008-305.
