  The applicant proposes that the service be devoted to programming from and about Africa and the African Diaspora that will be of interest and appeal to the African Canadian population. All programming will feature themes primarily focused on the nations of Africa, the African Diaspora, African heritage and culture and/or originate from an African nation.

  Application by Canadian Broadcasting Corporation for a licence to operate a national English-language Category 2 specialty television programming undertaking to be known as CBC SportsPlus.
  The applicant proposes a service which shall consist of programming dedicated primarily to the coverage and celebration of Canadian athletes with a particular emphasis on amateur athletes.
  The applicant states that it will offer no less than 80% Canadian content across the broadcast year and 80% of the evening broadcast period through its licence term.
  The applicant proposes that no less than 25% of the broadcast year be devoted to program category 6(b) Amateur sports.
  The applicant also proposes to offer programming from the following categories: 1, 2(a), 2(b), 3, 5(b), 6(a), 6(b), 11, 12, 13 and 14 as set out in Schedule I of the Specialty Services Regulations, 1990.
  In response to a deficiency letter, the applicant stated that:

  The applicant states that the programming will consist of programs related to disability issues and will target the billions of people in the world living with some form of visible or invisible disability.

  Application by TVA Group Inc. (TVA), for a new licence to continue the operation of the national French-language pay-per-view (PPV) known as Canal Indigo, resulting from a change in the ownership structure of Canal Indigo.
  The applicant is requesting issuance of a new licence under the same terms and conditions as those in effect under the current licence, except for the requested amendment described below to continue the operation of the undertaking.
  Canal Indigo's undertaking is currently held in partnership by TVA (20%), Cogeco Radio-Télévision inc. (20%), TQS inc. (20%) and Viewer's Choice Canada Inc. (40%), partners in a general partnership carrying on business as Canal Indigo, société en nom collectif.
  The proposed transaction will be effected through the transfer of the partnership interest held by the partners to TVA, a corporation controlled by Quebecor Media inc., in turn controlled by Pierre Karl Péladeau. Upon completion of the transaction, the partnership will be terminated and TVA will become the sole owner and licensee of the undertaking.
  The applicant is proposing to amend one of the conditions of licence of the PPV listed in Broadcasting Decision CRTC 2002-382. The condition of licence currently reads as follows:
 

8. The licensee is authorized to distribute Canadian programming, other than filler programming, which is produced by the licensee or by a person related to the licensee, but such programming shall not exceed, in each broadcast year, 20% of its Canadian programming schedule.

  And would be replace as follows:

a) The licensee is authorized to distribute, at its option, the signals WCCO-TV (CBS) Minneapolis, WHDH-TV (NBC), WCVB-TV (ABC), WFXT (FOX) Boston and WGBH-TV (PBS) Boston, as part of the basic service.

 

b) The licensee is authorized to distribute the following signals on a digital discretionary basis:

 

any of the distant Canadian television signals set out in the List of Part 3 eligible satellite services; and

 

a second set of signals that provides the programming of the four U.S. commercial networks (CBS, NBC, ABC, FOX) and the non-commercial PBS network (hereafter referred to as the U.S. 4+1 signals).

 

The distribution on a discretionary basis on the licensee's digital service of a second set of U.S. 4+1 signals and distant Canadian signals is subject to the provision that, with respect to such signals, the licensee adhere to the requirements regarding non-simultaneous program deletion set out in section 43 of the Broadcasting Distribution Regulations. The Commission may suspend the application of this provision, with respect to the signals to be distributed, upon its approval of an executed agreement between the licensee and broadcasters. Such an agreement must deal with issues related to the protection of program rights arising in connection with the discretionary carriage of a second set of U.S. 4+1 signals and distant Canadian signals solely on the licensee's digital service.

  The new station would operate on frequency 97.7 MHz (channel 249B) with an average effective radiated power of 50,000 watts (non-directional antenna/antenna height of 77.6 metres).
  The applicant is requesting permission to simulcast the programming of the new FM station on CFGT-AM for a period of 3 months from the date of implementation of the new station.
  The applicant is also requesting, pursuant to sections 9(1)(e) and 24(1) of the Broadcasting Act, the revocation of the licence of CFGT effective at the end of the simulcast period.
  This application was first scheduled to be heard at a public hearing on 13 May 2008 (Notice of Public Hearing CRTC 2008-1, 14 March 2008) but was withdrawn to be rescheduled at a later date.
  The Commission will consider the interventions already received, accepted and filed on the public file for the 13 May 2008 hearing as well as other interventions received in the context of this public hearing.

  Before initiating service through electronic mode, please ensure that you will be able to satisfy the Commission, upon request, that service of the notification was completed.
  Where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.
  Each paragraph of the document should be numbered.
  Your intervention should clearly identify the application and indicate whether you support or oppose the application, or if you propose changes to it, include the facts and grounds for your proposal.
  In the event that the application is brought to the oral phase of the hearing, and if you wish to appear, you must provide reasons why your written comments are not sufficient and why an appearance is necessary.
  Persons requiring communications support such as assistance listening devices and sign language interpretation are requested to inform the Commission at least twenty (20) days before the commencement of the public hearing so that the necessary arrangements can be made.

  Note that all information that you provide as part of this public process, except information granted confidentiality, whether sent by postal mail, facsimile, e-mail or through the Commission's Web site at www.crtc.gc.ca, becomes part of a publicly accessible file and will be posted on the Commission's Web site. This information includes your personal information, such as your full name, e-mail address, postal/street address, telephone and facsimile number(s), and any other personal information you provide.
  The personal information you provide will be used and may be disclosed for the purpose for which the information was obtained or compiled by the Commission, or for a use consistent with that purpose.
  Documents received electronically or otherwise will be put on the Commission's Web site in their entirety exactly as you send them, including any personal information contained therein, in the official language and format in which they are received. Documents not received electronically will be available in PDF format.
  Please note that the information you provide to the Commission as part of this public process is entered into an unsearchable database dedicated to this specific public process. This database is accessible only from the Webpage of this particular public process. As a result, a general search of our Web site with the help of either our own search engine or a third-party search engine will not provide access to the information which was provided as part of this public process.

  A list of all interventions/comments will also be available on the Commission's Web site. An electronic version of all interventions/comments submitted will be accessible from this list. To access the list, select "Lists of interventions/comments" under "Public Proceedings" from the Commission's Web site.
  Documents are also available during normal office hours at the local address provided in this notice and at the Commission offices and documentation centres directly involved with these applications or, upon request, within 2 working days, at any other CRTC offices and documentation centres.
