Licence Renewals for Private Conventional Television Stations

  The Commission will hold a public hearing commencing on 27 April 2009 at 9:30 a.m. at the Conference Centre, Portage IV, 140 Promenade du Portage, Gatineau, Quebec, to consider the applications described below.
  Preamble
  In Scope of licence renewal hearings for private conventional television stations, Broadcasting Notice of Consultation CRTC 2009-70, 13 February 2009 (Broadcasting Notice of Consultation 2009-70), the Commission stated that it would be predisposed to issue short-term licences, and reduced the scope of the hearing scheduled for the spring of 2009 to the following key issues:
 
  • the appropriate contributions to Canadian programming (local, priority and independently-produced programming), given the current economic conditions;
 
  • the terms of administration and delivery of the Local Programming Improvement Fund (LPIF), including the method of establishing the base-level expenditures for the purpose of determining incrementality;
 
  • whether to impose a 1:1 ratio requirement between Canadian and non-Canadian programming expenditures, both on a trial basis during a short-term licence, and on a longer-term basis; and
 
  • consideration of the terms for the digital transition by August 2011, in light of an industry working group report being prepared for the current public process.
  The Commission set out various questions in regard to its review of the scope of the licence renewal public hearings for private conventional television stations.
  The Commission has received, from private conventional television broadcasters, responses to those questions. These responses have been organized by broadcast group, and can be accessed through the following links:
 
  The private conventional television broadcasters were directed to indicate if they are requesting amendments to any existing conditions of licence, and the reasons for these requests, as the Commission intends to retain all other conditions of licence as they currently apply.

  The licensee has proposed to replace the regional stations CKMI-TV Québec and CIII-TV Paris with local undertakings with programming originating from Montréal and Toronto respectively. As local stations, they would be permitted to access local advertising in these markets.

  The Commission notes that Astral Media Radio G.P., Corus Entertainment Inc. and the Canadian Broadcasting Corporation have also submitted responses to the questions set out in Broadcasting Notice of Consultation 2009-70, although they do not have licence renewal applications being considered in this process.

  The intervention must be received by the Commission and by the applicant on or before the above-mentioned date. The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. In such a case, the intervention will not be considered by the Commission and will not be part of the public file.
  The intervention must include one of the following statements in either the first or the last paragraph:
  1 - I request to appear at the public hearing.
2 - I do not want to appear at the public hearing.
  Your intervention will be considered by the Commission, and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.
  Written interventions should be submitted to the Secretary General of the Commission in only one of the following formats:

  A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.
  The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.
  Parties must ensure, before initiating service through electronic mode, that they will be able to satisfy the Commission, upon request, that service of the notification was completed.
  Where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.
  Each paragraph of the document should be numbered.
  Interventions should clearly identify the application referred to and indicate it is an intervention in support or in opposition to the application, or, if the intervener propose changes to it, include the facts and grounds for your proposal.
  In the event that an application is brought to the oral phase of the hearing, and if the applicant wishes to appear, that applicant must provide reasons why its written comments are not sufficient and why an appearance is necessary.
  Persons requiring communications support such as assistance listening devices and sign language interpretation are requested to inform the Commission at least twenty (20) days before the commencement of the public hearing so that the necessary arrangements can be made.

  Note that all information that parties provide as part of this public process, except information granted confidentiality, whether sent by postal mail, facsimile, e-mail or through the Commission's website at www.crtc.gc.ca, becomes part of a publicly accessible file and will be posted on the Commission's website. This information includes personal information, such as full name, e-mail address, postal/street address, telephone and facsimile number(s), and any other personal information that parties provide.
  The personal information provided will be used and may be disclosed for the purpose for which the information was obtained or compiled by the Commission, or for a use consistent with that purpose.
  Documents received electronically or otherwise will be put on the Commission's website in their entirety exactly as they are sent, including any personal information contained therein, in the official language and format in which they are received. Documents not received electronically will be available in PDF format.
  Note that the information provided to the Commission as part of this public process is entered into an unsearchable database dedicated to this specific public process.
