Application by Jim Pattison Broadcast Group Ltd. (the general partner) and Jim Pattison Industries Ltd. (the limited partner), carrying on business as Jim Pattison Broadcast Group Limited Partnership to amend the broadcasting licence of the commercial radio programming undertaking CKPK-FM Vancouver.

The licensee proposes to exchange its frequency 100.5 MHz (channel 263C) with the 102.7 MHz frequency (channel 274B) held by Vancouver Co-operative Radio, licensee of CFRO-FM Vancouver.

The licensee also proposes to change the authorized contours by increasing the average effective radiated power from 2,700 to 51,000 watts (maximum effective radiated power from 11,000 to 100,000 watts with an effective height of antenna above average terrain of 590.4 metres).

The licensee offers that such an exchange in frequencies would allow CKPK-FM to operate more efficiently through its use of the 102.7 MHz frequency and enable it to compete on a level playing field in the Vancouver commercial radio market.

As part of the frequency exchange, Jim Pattison Broadcast Group Limited Partnership proposes to provide CFRO-FM technical, financial and marketing support for a period of 5 years for a total value of $1,437,000.

The Commission notes that with the proposed changes, the population in the 3 mV/m contour would increase from 2,103,336 to 2,322,750 and in the 0.5 mV/m contour from 2,342,800 to 2,908,400.

Application by Vancouver Co-operative Radio to amend the broadcasting licence of the community radio programming undertaking CFRO-FM Vancouver.

The licensee proposes to exchange its frequency 102.7 MHz (channel 274B) with the 100.5 MHz frequency (channel 263C) held by the Jim Pattison Broadcast Group Ltd. (the general partner) and Jim Pattison Industries Ltd. (the limited partner), carrying on business as Jim Pattison Broadcast Group Limited Partnership, licensee of CKPK-FM Vancouver.

The licensee also proposes to change the authorized contours by changing its antenna radiation pattern from non-directional to directional, by decreasing the average effective radiated power from 5,500 watts to 2,700 watts (maximum effective radiated power from 5,500 watts to 11,000 watts with an effective height of antenna above average terrain of 570.7 metres) and by changing the antenna site.

Vancouver Co-operative Radio offers that such an exchange in frequencies would ensure CFRO-FM’s survival by receiving technical, financial and marketing support from Jim Pattison Broadcast Group Limited Partnership for a period of five years with a total value of $1,437,000.

Although the licensee expects the impact on the market to be limited, the Commission notes that with the proposed changes, the population in the 3 mV/m contour would increase from 1,948,298 to 2,103,336 and in the 0.5 mV/m contour from 2,326,734 to 2,342,800.

The intervention must be received by the Commission and by the applicant on or before the above-mentioned date. The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. The intervention will not be considered by the Commission and will not be part of the public file.

Interventions will be considered by the Commission and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.

A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.

The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.

Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service of the notification was completed.

Submissions longer than five pages should include a summary.

In addition, where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.
