RE: TBayTel Agreement for the Provision of 9-1-1 Service Comments from Shaw Telecom G.P.


On 2 February 2010, the Commission received an application from TBayTel in which the company proposed a Master Toll Agreement – Appendix 2 – Provision of 9-1-1 Services between TBayTel and Bell Aliant Regional Communications, Limited Partnership (Bell Aliant). The Commission granted interim approval of the application on 15 February 2010 in Telecom Order CRTC 2010-90.


On 19 February 2010, the Commission received comments from Shaw Telecom G.P. (Shaw). In those comments, Shaw requested that the Commission:


1) immediately reverse the interim approval of the application and order TBayTel and Bell Aliant to modify the agreement such that confidential information related to Shaw, as well as future competitive local exchange carriers, not be shared between the parties; and


2) remind TBayTel that the NAS count, submitted by Shaw to TBayTel’s Carrier Access Group (CSG) on a monthly basis, is confidential information and should not be released to any outside parties or outside the TBayTel CSG itself.


With regard to the above, and in consideration of the urgency of this matter, you are requested to provide reply comments on or before 26 February 2010.
