Re: Tariff Notices – IP Relay Service

On 21 April 2010, the Commission received applications from Bell Aliant Regional Communications, Limited Partnership (Bell Aliant), Bell Canada, KMTS, MTS Allstream Inc. (MTS Allstream), NorthernTel Limited Partnership (NorthernTel), Saskatchewan Telecommunications (SaskTel), TELUS Communications Company (TCC), and Télébec, Société en commandite (Télébec), proposing amendments to their General Tariffs and/or Access Services Tariffs to introduce Internet Protocol (IP) Relay Service, pursuant to Accessibility of telecommunications and broadcasting services, Broadcasting and Regulatory Policy CRTC 2009-430, 21 July 2009 (Regulatory Policy 2009-430). In Regulatory Policy 2009-430, the Commission directed incumbent local exchange carriers (ILECs) to file these tariff modifications by 21 April 2010, with a proposed effective date of 21 July 2010.

By way of separate letters to the Commission, NorthernTel and KMTS proposed that they be permitted to change the effective date of these tariffs to 21 September 2010.

The Commission has previously approved a similar change in the effective date for Bell Aliant and Bell Canada on the basis that these companies had not yet found an appropriate third party vendor.

Commission staff notes that not all ILECs have filed tariff applications proposing the amendments required by Regulatory Policy 2009-430 and considers that there may be further requests to modify the proposed effective date for offering IP Relay Service. Commission staff is of the view that it would be appropriate to consider all applications of this nature concurrently. Consequently, the applications received from the above noted ILECs, along with associated subsequent revisions, will not be approved on an interim basis on the 15th calendar day of their receipt. However, the Commission intends to dispose of these applications prior to the end of July 2010. A list of applicable tariff notices is provided in the attachment.
