Re: Applications 2011-1383-6 (AUX TV), 2011-1382-8 (BITE TV), 2011-1381-0 (CURV TV) and 2011-1380-3 (TREK TV)

Mr. Abramson,

This is in reference to the applications by GlassBOX Television Inc. (GlassBOX) to amend the conditions of licence for the four above-noted services.

Section 28(1)(a) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure provides that the Commission may request parties to file information, particulars or documents where needed.

With respect to applications 2011-1381-0 (CURV TV) and 2011-1380-3 (TREK TV), please note that the Commission’s general practice is not to process licence amendment applications for Category B or Category 2 services that have not yet launched. Therefore, GlassBOX’s requests to amend CURV TV’s conditions of licence to permit it to broadcast categories 11(a) and 11(b) programming, and to amend TREK TV’s conditions of licence to permit it to broadcast categories 10, 11(a) and 11(b) programming, will not be addressed at this time.

However, as it would for any other unlaunched service, the Commission will consider your request to extend the launch deadline for TREK TV to 6 March 2013 and for CURV TV to 5 May 2014. The Commission will inform you of its decision in due course.

With respect to the remaining applications, 2011-1383-6 (AUX TV) and 2011-1382-8 (BITE TV):

  1. Please confirm whether GlassBOX would abide by Broadcasting Regulatory Policy CRTC 2010-786-1, Standard conditions of licence, expectations and encouragements for Category B pay and specialty services – Corrected Appendices 1 and 2. If not, please explain why.

You are required to provide the information/document(s) noted above on the public record by 31 October 2011.

A copy of this letter and all related correspondence will be added to the public record of the proceeding.
