Re: Canadian Marketing Association Part 1 Application to request a modification to the Unsolicited Telecommunications Rules, Part IV – ADAD Rules

Dear Mr. Hill,

The Commission is in receipt of letters dated 19 December 2011 from the Public Interest Advocacy Centre and the Samuelson-Glushko Canadian Internet Policy & Public Interest Clinic and a letter dated 20 December 2011 from the Canadian Marketing Association (CMA) in connection with the proceeding initiated by the CMA’s above-noted Part 1 application.

In light of the comments received, Commission staff is of the view that it would be appropriate to defer consideration of the matters raised by the CMA’s application to allow the Commission to consider whether the CMA’s application should be reviewed in a broader context. Accordingly, Commission staff suspends the proceeding initiated by the CMA’s application until such time as the Commission determines the appropriate process.
