Subject: Application 2013-1548-2 – Renewal of licence for CFEI-FM Saint-Hyacinthe, Quebec

Dear Ms. Meloul:

This is in response to your letter to the Commission dated 24 March 2014, asking to have the intervention of Éric Tétreault, managing director of Radio communautaire de la Rive-Sud inc. (CHAA-FM Longueuil), dismissed and removed from the public record.

In your letter, you stated that:

CHAA-FM’s intervention was received on 18 March 2014, four days after the deadline for submitting interventions, as specified in Notice of Consultation CRTC 2014-47;

The intervention also discussed the renewal of CFZZ-FM, which is included in Notice of Consultation CRTC 2014 56, and for which the deadline for receiving interventions and replies was 17 March 2014; and

A partial (“abridged”) copy of this intervention was sent by the intervener to Bell Media on 20 March 2014. Consequently, Bell Media could not respond to the confidential information.

To that end, we note the following:

CHAA-FM initially filed its intervention with the Commission on 14 March 2014, which was within the deadline for submitting interventions. However, because the intervention was submitted in confidence, staff asked CHAA-FM to submit an abridged version for the public record. It was therefore in response to Commission staff’s request that CHAA-FM submitted an abridged version of its intervention on 18 March 2014, which was sent to you in full on 20 March 2014.

Because the intervention did contain information about the licence renewal for CFZZ FM Saint-Jean-sur-Richelieu, and because the deadline for submitting interventions related to that application was 5 March 2014, this intervention will not be part of the public record for that renewal application.

With regard to the confidential information related to CHAA-FM’s financial data for the past five years, staff notes that disclosing this information could indeed cause specific direct harm to the licensee that would outweigh the public interest in disclosure. It is Commission practice not to disclose this type of information.

In light of the foregoing, we consider it appropriate to retain CHAA-FM’s intervention in the public record for application 2013-1548-2.

A copy of this letter and any related correspondence will be added to the public record of the proceeding.
