RE: Review of basic telecommunications services, Telecom Notice of Consultation 2015-134Footnote 1 – Request for disclosure of information designated as confidential

This letter addresses a request for disclosure of information designated as confidential in the proceeding initiated by Telecom Notice of Consultation 2015-134.

By letter dated 12 August 2015, the Affordable Access CoalitionFootnote 2 (the AAC) requested disclosure of certain information for which confidentiality had been claimed in connection with requests for information dated 7 May 2015.

Specifically, the AAC requested that the Commission disclose aggregated information provided by telecommunications service providers in response to the Commission’s request for information ____(CRTC)7May15-8.Footnote 3 The AAC submitted that disclosure of this information may assist parties in evaluating central factual matters in the proceeding, and that the requested information would be more current than the information available in the 2014 Communications Monitoring Report.  AAC requested that the aggregated information be disclosed as soon as possible, ideally well before the 2 November 2015 deadline for asking second-round interrogatories in this proceeding.

On 25 August 2015, Rogers Communications Partnership (RCP) and TELUS Communications Company (TCC) requested that the Commission maintain confidential treatment for the information in question. RCP and TCC both submitted that aggregating the data would not provide meaningful information, and that the information sought by the AAC would be found in the 2015 Communications Monitoring Report, which should be released well before the 2 November 2015 deadline for the next round of interrogatories.

The 2015 Communications Monitoring Report containing, among other things, information on broadband Internet availability and penetration in Canada will be released in mid-October 2015 and will provide the information sought by the AAC. Accordingly, a determination on the AAC’s request for disclosure is not necessary.

Telecommunications service providers (TSPs) were requested to provide a) the total number of households the TSP is capable of serving; b) the total number of households served by the TSP; and c) the total number of households served by the TSP that meet the Commission’s broadband Internet target speeds of 5 megabits per second (Mbps) download and 1 Mbps upload.
