Penalty: $32,500

Pursuant to section 72.07 of the Telecommunications Act, S.C. 1993, c. 38(the Act), the undersigned has issued this Notice of Violation finding 1757364 Ontario Inc. (doing business as Eagle Water of Ontario) to have committed the following violations contrary to the Canadian Radio-television and Telecommunications Commission’s (CRTC’s) Unsolicited Telecommunications Rules (the Rules) made under section 41 of the Act:

On and between 17 December 2012 to 21 March 2014, voice telemarketing telecommunications were made by 1757364 Ontario Inc. (doing business as Eagle Water of Ontario) resulting in violations of the following Rules: Part II, section 4 for initiating telemarketing telecommunications to consumers whose telephone numbers were registered on the National Do Not Call List (DNCL); Part II, section 6 of the Rules for initating telemarketing telecommunications during a time when Eagle Water of Ontario was not subscribed to the National Do Not Call List; and Part III section 23 of the Rules for failing to comply with the permissible calling hours.

Pursuant to section 72.01 of the Act, the undersigned has determined that the total penalty for the violations identified above is $32,500.

The penalty of $32,500 must be paid by 1757364 Ontario Inc. (doing business as Eagle Water of Ontario) to “The Receiver General for Canada” in accordance with subsection 72.09(3) of the Act.
