RE: Application for costs award with respect to the participation of Ryan Adams in Telecom Notice of Consultation 2015-134, Review of basic telecommunications services

Dear Mr. Adams,

The Commission received your application for costs dated 11 June 2016 with respect to your participation in Telecom Notice of Consultation 2015-134, Review of basic telecommunications services (the proceeding).

The purpose of this letter is to request additional information from you regarding your application for costs.

  1. Criteria for an Awards of Costs

    Pursuant to section 68 of theCanadian Radio-television and Telecommunications Commission Rules of Practice and Procedure(the Rules of Procedure), the Commission determines whether to award final costs on the basis of the following criteria:

    1. whether the applicant had, or was the representative of a group or a class of subscribers that had, an interest in the outcome of the proceeding;

    2. the extent to which the applicant assisted the Commission in developing a better understanding of the matters that were considered; and

    3. whether the applicant participated in the proceeding in a responsible way.

    You are requested to indicate in detail how you have satisfied the Commission’s criteria for an award of costs.

  2. Appropriate Costs Respondents

    Pursuant to section 66(1)(b) of the Rules of Procedure, an application for costs must identify the respondents that should pay the costs. Please indicate who you consider the appropriate costs respondents to be.

  3. Missing Documents

    It appears from your costs application that you are only applying for the costs of your disbursements. In the cover letter to your costs application you note that a Form IV – Affidavit of Disbursements is attached, however, it does not appear to be included in the application.

    If you are applying for disbursements, in order to assess your application for costs, the Commission also requires you to submit (1) a Form IV – Affidavit of Disbursements; and (2) a Form V – Summary of Fees and Disbursements.Footnote 1  

Filing Information with the Commission

The requested information is to be filed with the Commission by 12 September 2016. Any other interested party may file a response by 19 September 2016. You may reply to any comments no later than 26 September 2016. 

A copy of this letter and all related correspondence will be added to the public record of the proceeding.
