RE: Bell MTS Tariff Notice 846 – New Business Service Individual Semi-Public Line Rate Ranges in Manitoba – reclassification as a Group B application

Dear Philippe Gauvin:

On 17 June 2022, the Commission received an application from Bell MTS, proposing changes to its General Tariff (GT) Item 475 – Rate Schedule for Primary Exchange Service, non-contracted Business Service - Individual Semi-Public Line (or Individual Semi-Public Line Service). The company is proposing to introduce rate ranges for Individual Semi-Public Line Service in all rate bands.

Bell MTS submitted that this tariff filing is a Group A filing, indicating that it pertains to changes to previously approved rates for existing retail tariffed services where the revised rates comply with the Commission's price regulation rules.

Commission staff is of the view that the application does not comply with the requirement in Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin 2010-455-1, 19 February 2016 that the revision be restricted to proposing changes to previously approved rates for retail services. Specifically, rather than proposing a rate change to a previously approved rate, the introduction of rate ranges changes how customers could potentially be charged for this service.

For efficiency, the Commission will process this application as a Group B tariff filing rather than close the file and require the company to refile it as a new application. As such, interested parties may file interventions within 30 calendar days of the date of this letter, and Bell MTS may file reply comments within 10 calendar days of the deadline for filing interventions. Accordingly, the application will not come into effect 17 June 2022 as proposed by the company.
