Pursuant to Public Notice CRTC 1991-125 dated 5 December 1991, the Commission approves the application by Télécâble Laurentien Inc. to amend its licence for the cable distribution undertaking serving Rockland and Clarence Point, by adding a condition of licence allowing the licensee to distribute, at its option, the programming service of MuchMusic, as part of the basic service. In accordance with subsection 10(2) of the Cable Television Regulations, 1986, subject to a condition of licence, a cable television licensee operating in a francophone market may distribute the English-language specialty service MuchMusic only on a discretionary basis.
In assessing this application, the Commission has taken into consideration the fact that this undertaking serves a bilingual community.
Accordingly, it is a condition of licence that the licensee be relieved of the requirement that it distribute MuchMusic as a discretionary service. However, the licensee is authorized to distribute MuchMusic as part of the basic service only so long as it also distributes the French-language specialty service MusiquePlus as part of the basic service. The Commission expects these specialty services to be distributed on channels below channel 31.
In a related decision released today (Decision CRTC 92-73), the Commission approved an application by CHUM Limited (MuchMusic Network) to amend the condition of licence regulating its wholesale rate, by charging Télécâble Laurentien Inc. a wholesale rate of $0.01 until 31 December 1992 and $0.02 from 1 January 1993 to 31 August 1993.
