Following a Public Hearing in Quebec City beginning on 19 May 1992, the Commission renews the broadcasting licence for the radio programming undertaking consisting of CIKI-FM Rimouski and its transmitter CIKI-FM-2 Sainte-Marguerite-Marie, from 1 September 1992 to 31 August 1996, subject to the conditions specified in this decision and in the licence to be issued.
This term will enable the Commission to consider the renewal of this licence at the same time as that of other radio stations in the area.
The Commission reaffirms the particular importance it attaches to the development of Canadian talent and has noted the level of the licensee's commitment for this purpose in light of the station's financial situation.
The Commission granted the licence for CIKI-FM to the licensee in 1986 (Decision CRTC 86-1127 dated 26 November 1986). In view of the potential impact of the new station on the neighbouring market, the Commission issued the licence on the condition that the licensee not solicit local advertising in the Baie-Comeau market and in the surrounding markets served by local stations. The Commission reaffirmed this requirement in Decision CRTC 91-803 dated 10 October 1991. Subsequently, Radio Côte-Nord Inc. and the Baie-Comeau Chamber of Commerce expressed concern to the Commission about CIKI-FM's advertising practices, and alleged that the licensee was not adhering to the condition of licence noted above. The Commission has corresponded with the licensee regarding this issue and is satisfied with the licensee's response.
It remains a condition of licence that the licensee not solicit local advertising in the Baie-Comeau market and the surrounding areas served by local stations. The Commission requires the licensee to comply with this condition of licence at all times. In this context, the Commission will generally consider that any measure taken by a licensee with a view to establishing relations with new clients constitutes solicitation.
