CJIT-FM - Acquisition of assets

  The Commission approves the application by Les Productions du temps perdu inc. to acquire from 9063-0104 Québec inc. the assets of the radio programming undertaking CJIT-FM Lac-Mégantic, Quebec.
 

The application

The Commission received an application by Les Productions du temps perdu inc. (Les Productions du temps perdu) for authority to acquire the assets of the French-language FM commercial radio programming undertaking CJIT-FM Lac-Mégantic from 9063-0104 Québec inc., doing business under the name of Radio Gaé-Rit Lac Mégantic (Radio Gaé-Rit). The applicant also requested a broadcasting licence to continue the operation of the undertaking under the same terms and conditions as those set out in the current licence.

CJIT-FM is the only broadcasting undertaking owned by Radio Gaé-Rit.

Les Productions du temps perdu is a corporation owned and controlled by Mr. Louis Longchamps. On 7 September 2006, the Commission administratively authorized Les Productions du temps perdu to assume temporarily the management of the radio programming undertaking CJIT-FM Lac-Mégantic.

Following the acquisition of the above-mentioned assets, effective control of the radio programming undertaking CJIT-FM Lac-Mégantic will be transferred to Les Productions du temps perdu.
 

Value of the transaction

The value of the transaction is estimated at $200,000 and is based on the undertaking's history, comparison with stations in similar markets and review of the sales over the past few years. The Commission finds this valuation method acceptable and reasonable under the circumstances.
 

Tangible benefits

Pursuant to Commercial Radio Policy 1998, Public Notice CRTC 1998-41, 30 April 1998, Les Productions du temps perdu proposes a tangible benefits budget package of $12,012, which represents a direct financial contribution of a little over 6% of the value of the transaction.

This financial contribution will be allocated over seven broadcast years and will be distributed annually to MusicAction ($858) and the Canadian Music Marketing and Promotion Fund ($858).

The Commission received an intervention in support of this application.

 

Commission's analysis and determinations

In light of the above, the Commission approves the application by Les Productions du temps perdu inc. for authority to acquire the assets of the radio programming undertaking CJIT-FM Lac-Mégantic.

10.

Upon surrender of the current licence, the Commission will issue a new broadcasting licence to Les Productions du temps perdu. The new licence will expire 31 August 2013 and will be subject to the same terms and conditions as those set out in the current licence, as stipulated in Conversion of AM station CKFL to FM, Decision CRTC 2000-757, 15 December 2000.
 

Employment equity

In accordance with Implementation of an employment equity policy, Public Notice CRTC 1992-59, 1 September 1992, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
