PREAMBLE
Items 1 to 18
On 12 March 2007, the Commission issued Broadcasting Public Notice CRTC 2007-24, calling for applications for a broadcasting licence to carry on a radio programming undertaking to serve Owen Sound, Ontario.
On 8 June 2007, the Commission issued Broadcasting Public Notice CRTC 2007-61, and on 13 June 2007 issued Broadcasting Public Notice 2007-61-1, calling for applications for a broadcasting licence to carry on a radio programming undertaking to serve Windsor, Ontario.
On 22 June 2007, the Commission issued Broadcasting Public Notice CRTC 2007-67, calling for applications for a broadcasting licence to carry on a radio programming undertaking to serve Peterborough, Ontario.
In response to these calls, the Commission has received a number of applications for licences to serve these markets.
Some of these applications are technically mutually exclusive. These applications are:

For Owen Sound

Items 1 to 4 are technically mutually exclusive proposing the use of the frequency 92.3 MHz.

These applications will be treated as competitive radio applications for Owen Sound.

For Windsor

Items 5 and 6 are technically mutually exclusive proposing the use of the frequency 95.9 MHz.

These applications, along with items 7 and 8 will be treated as competitive radio applications for Windsor.

For Peterborough

Items 9 to 16 are technically mutually exclusive proposing the use of the frequency 96.7 MHz.

In addition, items 17 and 18 propose new commercial radio services for Kawartha Lakes that are also technically mutually exclusive for the use of the frequency 96.7 MHz. While these applications were not submitted in response to Broadcasting Public Notice CRTC 2007-67, the proximity of Kawartha Lakes to Peterborough and their proposed use of 96.7 MHz render these applications technically mutually exclusive with items 9 to 16. Accordingly, items 17 and 18 will be scheduled as part of the competitive phase at the hearing where the Commission will consider the Peterborough new radio applications.

The Commission intends to consider, subject to interventions, items 19 to 38 during the non-appearance phase of the public hearing.

  The licensee advised that a "nested" FM solution is the best means to improve the access to CBE and enhance the quality of service to Windsor-area listeners, especially those in Windsor's downtown core. In addition, it noted that half of the potential listener base has been lost to the Detroit market and half of what remains does not listen to AM at all.

  The new station would operate on frequency 96.7 MHz (channel 244C1) with an average effective radiated power of 6,000 watts (maximum effective radiated power of 20,000 watts/antenna height of 273.2 metres).
  The applicant proposes to maintain CKRU's current Oldies music format on the proposed FM station.
  The applicant is also requesting approval to operate under the condition of licence set out in Public Notice CRTC 1998-132 allowing it to broadcast a minimum level of 30% Canadian content in any broadcast week where at least 90% of musical selections from content category 2 that it broadcasts are selections released before 1 January 1981.
  The applicant is requesting permission to simulcast the programming of the new FM station on CKRU for a period of three months from the date of implementation of the new station.
  The applicant is also requesting, pursuant to sections 9(1)(e) and 24(1) of the Broadcasting Act, the revocation of the licence of CKRU effective at the end of the simulcast period.

  The transmitter would operate on frequency 96.1 MHz (channel 241A) with an effective radiated power of 5,450 watts (non-directional antenna/antenna height of 105 metres).
  The licensee states that CFOS suffers from serious day-time signal deficiencies in its main market of Owen Sound from October to March. This transmitter will fill in the coverage gaps to the area as well as in the Grey Bruce Region of Ontario.
  The Commission will only proceed with this application at the public hearing if advised by the Department of Industry, at least twenty days prior to the hearing, that it is technically acceptable.

  The licensee proposes, on average, up to a maximum level of 24 hours per week of local programming relevant to the Cobourg and Northumberland County area on the new station.
  The proposed 24 hours of local programming could consist of up to 18 hours 54 minutes of advertising content directed to Cobourg and Northumberland County listeners. Of the 18 hours 54 minutes of advertising, up to 12 hours 36 minutes would be differentiated local advertising, where such advertising is not broadcast on the applicant's CFMZ-FM-1 Toronto station 96.3 MHz during the same broadcast week.
  The balance of the 24 hours of local programming would consist of up to 4 hours 12 minutes of locally relevant spoken word content. This would include arts billboards, PSA's, community messages, regional information, station ID's and promos specific to the Cobourg and Northumberland County area.
  Programming will originate from the licensee's Toronto studio, but be produced for exclusive broadcast on the new Cobourg FM station.

  The new station would operate on frequency 103.7 MHz (channel 279B) with an effective radiated power of 27,000 watts (non-directional antenna/antenna height of 51.7 metres).
  The applicant would maintain its current country music format targeting listeners aged 18 to 40.
  Approval of this application will see the licensee exceed the ownership limits for commercial radio licensees as set out in Public Notice CRTC 1998-41 dated 30 April 1998, Commercial Radio Policy 1998 (the policy). Under the policy, "in markets with less than eight commercial stations operating in a given language, a person may be permitted to own or control as many as three stations operating in that language, with a maximum of two stations in any one frequency band." In the case of Golden West, approval of these technical parameters will see the new Winkler/Morden FM station overlap the 3mV/m contours of CJEL-FM Winkler and the 5mV/m contours of CKMW Winkler/Morden and CFAM Altona.
