CFRS-DT Saguenay, CFKS-DT Sherbrooke, CFKM-DT Trois-Rivières, CFAP-DT Québec and CFJP-DT Montréal – Licence amendments related to coverage of the 2012 Olympic Games

The Commission approves an application by V Interactions inc. for temporary relief from conditions of licence relating to the production and broadcast of local programming as well as to the broadcast of news from 27 July through 12 August 2012 inclusively. This relief is necessary to accommodate V Interactions inc.’s coverage of the Olympic Games.

The application

1.  The Commission received an application from V Interactions inc. (V Interactions) for temporary relief from conditions of licence relating to the production and broadcast of local programming as well as to the broadcast of news for the French-language conventional television programming undertakings CFRS-DT Saguenay, CFKS-DT Sherbrooke, CFKM-DT Trois-Rivières, CFAP-DT Québec and CFJP-DT Montréal. This relief would apply from 27 July to 12 August 2012 inclusively, because of the coverage by the V network of the Olympic Games.

2.  V Interaction’s current conditions of licence relating to the production and broadcast of local programming as well as to the broadcast of news for the above-mentioned stations read as follows:

CFJP-DT Montréal

1. The licensee shall produce and broadcast at least 15 hours of local programming per week, including at least 2 hours of Category 1 news.

2. In addition to the 2 hours of Category 1 news required by condition of licence no. 1, the licensee shall broadcast at least 30 minutes of Category 1 news every Saturday and every Sunday.

CFAP-DT Québec

1. The licensee shall produce and broadcast at least 10 hours of local programming per week, including at least 2 hours of Category 1 news.

2. In addition to the 2 hours of Category 1 news required by condition of licence no. 1, the licensee shall broadcast at least 30 minutes of Category 1 news every Saturday and every Sunday.

CFKM-DT Trois-Rivières, CFKS-TV Sherbrooke et CFRS-DT Saguenay

1. The licensee shall produce and broadcast at least 1 hour and 30 minutes of local programming per week, including at least 1 hour of Category 1 news.

2. In addition to the 1 hour of Category 1 news required by condition of licence no. 1, the licensee shall broadcast at least 30 minutes of Category 1 news every Saturday and every Sunday.

3. The Commission received one opposing intervention from the Canadian Union of Public Employees (CUPE) to which V Interactions has replied.

4. CUPE was of the view that the Commission should require the broadcast of at least 30 minutes of original local news at the bottom of the screen on Saturdays and Sundays. In reply, V Interactions explained that the periods normally set aside for the broadcast of news on the V network stations will be occupied by the broadcast of live olympic events. As well, V Interactions noted that the Commission has approved similar licence amendments for RNC Media in Broadcasting Decision 2012-351 and for Bell Media Inc. in Broadcasting Decision 2012-350.

Commission’s analysis and decision

5. The Commission notes the concerns raised by the intervener as well as the applicant’s reply. The Commission considers that it is of value to French-language viewers to receive broadcast coverage in French of special international events such as the Olympic Games. The Commission is therefore of the view that the flexibility that V Interactions has requested for the duration of the 2012 Olympic Games is appropriate.

6. Consequently, the Commission approves the application by V Interactions inc. for temporary relief from conditions of licences relating to the production and broadcast of local programming as well as to the broadcast of news for the French-language conventional television programming undertakings CFRS-DT Saguenay, CFKS-DT Sherbrooke, CFKM-DT Trois-Rivières, CFAP-DT Québec and CFJP-DT Montréal. This relief will apply from 27 July to 12 August 2012 inclusively.

7. In order to implement this relief, the Commission amends the broadcasting licences for the above-mentioned stations by adding the following condition of licence to each of the broadcasting licences for the above-mentioned stations:

For the period from 27 July to 12 August 2012 inclusively, the licensee is relived of the requirements of conditions of licence 1 and 2 set out in the appendices 1, 3, 4, 5 and 6 to Change in the effective control of TQS inc. and licence renewals of the television programming undertakings CFJP-TV Montréal, CFJP-DT Montréal, CFAP-TV Québec, CFKM-TV Trois-Rivières, CFKS-TV Sherbrooke, CFRS-TV Saguenay and of the TQS network, Broadcasting Decision CRTC 2008-129, 26 June 2008.
