Terrestrial broadcasting distribution undertakings serving various locations in Ontario – Revocation of licence

  1. The Commission received an application from Comwave Networks Inc. in which the licensee requested the revocation of its regional broadcasting licence for terrestrial broadcasting distribution undertakings (BDUs) serving various locations in Ontario. The licensee submitted that it was eligible to continue the operation of its BDUs as exempt undertakings pursuant to the exemption order for terrestrial broadcasting distribution undertakings serving fewer than 20,000 subscribers (Broadcasting Order 2017-320), set out in the appendix to Broadcasting Regulatory Policy 2017-319.
  2. The Commission has confirmed that the licensee satisfies the criteria of Broadcasting Order 2017-320. Further, the licensee has paid all outstanding contributions to Canadian programming, including those detailed in a Commission letter dated 27 October 2021.
  3. In light of the above, and pursuant to paragraph 9(1)(f) of the Broadcasting Act, the Commission revokes the regional broadcasting licence issued to Comwave Networks Inc. for the terrestrial BDUs serving various areas in Ontario, last renewed administratively in Broadcasting Decision 2023-245.
  4. The operator of this undertaking must, at all times, adhere to the terms and conditions set out in Broadcasting Order 2017-320.
